Supportomatic is right, the issue is with the trademark. They have to protect their mark otherwise it could become generic:

Still does suck though, and they're still probably going a bit overboard with it.

Yes, definitely. I get these like once a month. Its like theres a gigantic bullseye on my site even though Im just a small spec in the bigger scheme of things.

I looked up monster energy drink layouts and all the big sites have them.

msbooya is on a distinguished road
I just got a letter from "Continental Enterprises" demanding $4,700 because someone uploaded a Monster layout to my site, saying they'd sue me if I don't pay up.. They did the same for a Heineken logo. Trademark extortion is fun isn't it!

I suggest everyone search their sites for Monster energy or Heineken logos, and boycott both companies too.

Why boycott them? You know what the risks are when you use a trademark and profit from it :S

Because they're douchebags. And how are you supposed to catch every single trademarked thing when you have thousands and thousands of pictures uploaded daily? Search photobucket for monster energy. I don't see them getting sued.

I wouldnt' mind a simple C&D, but the "pay up or else" is extortion.

I think the pay or else is nonsense because they can't force you to do anything unless they take you to court. I doubt they'll go that far for a layout. Just remove the layout, apologize and forget about it.

Just don't allow uploads, it's mostly stolen stuff from other resource websites anyway.

Yeah, I suppose photobucket and myspace should stop allowing uploads too, huh.
