It's not so much the big companies but these companies do have people in their copyright protections department who look for things like this.

It's better to do what they say of course, I wonder what's next

I don't understand this either. We will never make more than them from a layout or even the complete sites we own. And yes, I see it as free advertisments and publicity. The people who use those layouts are fans of the drinks and the ones who built up the company in the first place. You wouldn't use a montster layout if you never drank them. If you use that layout, you prolly drink them daily!
