I think i'm done selling my graphics.
In the past week, I have found 6 sites that I have my layouts on there without my permission. Meaning they did NOT pay for them, or ask for any type of permission!!
When asked to remove them, they refuse. This is seriously pathetic.
Oh and then one is telling me "its a search engine" - It sure as hell don't look like a search engine to me. And funny thing is -- out of all the layouts on the internet atleast a good 50-100 of them are mine. All from the SAME PACK of layouts I sold. Funny?
Wtf is up with people these days? What gets me is it's the people who are raking in the dough. This is what I do to support my family. Every penny counts. And these people ranking in the dough over here, just come and snatch it up liek its nothing.
RAWR. I'm sick of this. I mean, if you could ATLEAST ask me, maybe i'd be ok with it.
No credit.
No permission.
No payment.
I'm sick of it.

I dont think thats a good idea, yes there are some people who steal content and know they are stealing content. However there really are people who buy content and doesnt know it was stolen. It wouldnt be fair to start accusing people of such and such without them being around to clear themselves.
Precious: btw, how many total layouts do you have around the internet? Maybe you can make some money off it by going to these people and asking them for a payment.

i bought packs of tagged stuff as mentioned in another thread, not knowing it was tagged. i've probably got unauthorized stuff on my site too (not tagged). if i were asked to remove something, and i know i didnt purchase from the original creator, and i didnt make it. i would remove it and just make my own. its better than going through legal stuff.
and it happened with jess too, her glitter drinks were being sold/stolen. however, that was a lesson learned.

since we are on the topic...i know we need to protect our images. but i KNOW large site owners...or even just site owners in general go around and steal stuff that isnt tagged. its been going on forever, and willl continue. but those people are low.....im completely sick of it too and i am investigating unauthorized selling of my packs as well. god, hire a freaking designer and get your own crap.
all my stuff is gonna be tagged, and all my sales required tagging as well.

I know of atleast 2 other designers on here whose content was stolen by one of the sites -- who turns out to have close to 300 of my layouts.
I contacted one of them, and will contact the other in the morning.

how much for the complete set? 500? maybe you should try and focus a little more on making money than going after thieves, theres pretty much nothing you can do...we all are a victim of it in some way. at least people arent reselling your layouts on these forums.

Sorry Angiie. I know it sucks that it happened. And I know a couple other things going on in this forum regarding other members are part of scams as well and I'm getting pretty freaking pissed that they are still around. And when some things play out, I hope they are outted for what they did.

I personally think that they should be posted in the public. At the very least everyone should know who the scum are and be able to avoid them easier.
Of course only after you tried contacting them and they flat out tell you to f off.
Yeah, they might claim that all the images, brushes and such that are used for your work is copyrighted so they have just as much right to use it but that is bull and a lame excuse. Does that mean that if they downloaded mp3s illegally that I can break into their house to steal their burned cds?
My vote is to list them once you know they know they are using stolen work and they refuse to remove it.
This is part of the reason I only buy layouts here lol. At least I know if someone was trying to sell me stolen work the real designer would probably see it.

I'm pretty damn pissed myself. I see my layouts on there as well and to be quite frank, if this isn't handled correctly, you can forget my support ever being given on this forum. To see things like this tolerated on these forums when I was here from the beginning, when almost NOTHING was tolerated, and what was right always prevailed.
If people can get away with screwing people over and CONTINUE screwing people over, it just shows where the priorities of this forum lie. I won't allow myself to be ****ed over, and its not something I take lightly. They can have my damn layouts, I have NO problem with letting them use them, if they'd ask me for permission instead of being lowdown selfish dicks who don't care about others. Business my **** its called being selfish and idiotic. This better be handled, and thats all I have to say. If I was still a mod, lets just say the person who stole the layouts WOULDN'T still be here.

1500.00 - 2500.00 really is not a lot of money when you think about what it will save you in the long run. And that amount will last you a long time. You could have an attorney respresenting you for as long as a year or longer on that amount.
And if the services are never needed, you get this money back.

I agree, and if we were link exchanging, advertising, etc on their site, we could stop. It just makes things easier. Plus Angiie, if they didn't take the stuff off, you have the 100% right to give out their names.

Actually, you're kinda right there. I've seen someone else exposed on here before and nothing was done. The person just kinda left MSP after they realized they were exposed, and they continue to steal glitters today. :\

but yeah stolen content is not good, but user submittied content suck...most myspace resource sites all have stolen content, patterns and a bunch of other things,when people make a gucci layout using the gucci pater this is in fact a copy right breach.
media release images may be ok but most sites have some stolen or non copy right stuff on them..

Lets consider Walt Disney. People use disney images all the time. Do you think Walt Disney cares? NO! You know why? Its called label recognition / Free Advertisment. Walt Disney is not releasing any new winnie the poo movies, but they do still sell the old winnie the poo videos. Well guess what, when people have winnie the poo images and layouts, this is just a reminder, advertisement, reminder, and label recognition.
Stealing another sites stuff is one thing, but being a free advertising portal for companies such as gucci, good for them and us. =/
And if they didn't want you using it dont you think they would send you a real nasty letter asking you to remove it? I recieved a letter from Smiley Central once almost a year ago because I had their smileys on my site.

I have to disagree also. There is strenth and power in numbers.
I believe that a site should be contacted and given the opportunity to make it right by either removing the offending items or by paying for them. But she has done that and they responded telling her they will not do remove the stuff or pay for it..
If people with good business ethnics band together, refusing to do business with those who work in an unethical manners, they will fall. Without the support of other sites with link exchanges, selling them content, etc. they will fall.
So with that said, I have to disagree.

Exactly ;) People use pictures of celebrities like 50 Cent all the time, but I doubt he's contacted them saying "Please remove my picture from your site!" In a sense, it's free publicity for the person in the image.

Yeah, actually, you are true Angiie. I forgot that you handdraw alot of your layouts. And you drew all those awesome scribbles. Anyway, if he refuses, tell him something like, "If you fail to remove my layouts, I will contact my lawyer" or something. My mom did something like this before with someone that did something to our car or something, and they paid us what we were owed. [She just gave him my aunt's name and said that was our lawyer]. When you drop the word "lawyer" or "sue", then they tend to listen to you more and you have a better chance of them removing the content.

Yeah. He tried throwing the copyright crap in my face and saying he works for some artist label or something and I said well alot of my were hand drawn so they are copyright to me - he STILL refuses to remove them.

That also shows there may be at least 2 aholes in this sittuation. The site that uses the stolen content after knowing it is stolen and possibly the person that was part of that group buy and gave or sold it to the site. Of course it may have just been taken from other sites but hard to say.
If the site owner has a right to use the content either buy buying it or buying a site that had it then that is fine and he shouldn't have an issue. But in this case it sounds like he doesn't have the right and knows it but just laughs about getting away with it. I have a problem with that on many different levels. I would personally like to be part of a community that doesn't welcome scammers once they are found out or once they decide to start scamming (like George). If they are find being the aholes they are then let them do it elsewhere...at least in my opinion if that mattered.

I had to kind of laugh about this. (not that its funny)
I recieved a letter once (over a year ago) from Smiley Central because I had a huge amount of thier smiley's on my site available for users to use. I didnt get the smileys from their site, they were already available everywhere. But you better bet, when they asked me to remove them, I did exactly that.

Completely agreed. If a pattern or logo is TRADEMARKED and you go ahead and make some layouts using a companies pattern that is trade marked and make profit from it, they have the right to sue you, but will they sue you? its a risk people take.So you are saying that you wouldn't mind if I went to all the sites in your sig, copied the content (since some of it is trademarked or copyrighted by other people) and put all that on my own domains you wouldn't have a problem with it? If not let me know as that would save me a ton of time getting content for new sites :).

Exactly. MSP isn't a place to get screwed over by people, etc. Yeah, we don't want people automatically assuming that MyEeos is going to be a bad place. Because it wont. It's just the losers out there that like scamming/screwing people over. They're everyone.

There is not a lawyer for any company in the world that would not first send a demand letter requesting that you remove the offending content. If they really want it removed then you will get one of these letters.
But to think they are out there looking to jump into court over it is silly. No judge would even hear a case whereas the site was not first given the oppotunity to correct the issue.
But I do believe that some of these business can see how this is a positive thing since it is without a doubt free advertising, and helps in label recognition.
No one is saying they cant and wont contact you.

Exactly, you have done nothing wrong. You are not claiming to be the model or anything. Okay, what about all the fakes on MySpace that have a picture of Paris Hilton, for instance, and say "Hey, I'm Paris Hilton", etc. etc. That's illegal, but using a picture in a preview isn't really. Noone has the link to the MySpace profile or anything, alls they get to see is the picture in the preview, that's all

There is not a lawyer for any company in the world that would not first send a demand letter requesting that you remove the offending content. If they really want it removed then you will get one of these letters.
But to think they are out there looking to jump into court over it is silly. No judge would even hear a case whereas the site was not first given the oppotunity to correct the issue.
But I do believe that some of these business can see how this is a positive thing since it is without a doubt free advertising, and helps in label recognition.
No one is saying they cant and wont contact you.
True, very true. It's like MySpace, if someone has the word "myspace" in their domain name, and MySpace doesn't want that site up anymore, they contact the site requesting it be taken down. MySpace doesn't drop a big lawsuit without first requesting the site be taken down, seriously.

Just to let you know, that picture is absolutely everywhere. It was used by spammers a few months ago as a fake youtube video so people clicked the picture hoping to get to a video of some hot chick bouncin around but they probably got taken to a fake login page or something.

And also just made a point about people using patterns and logos in layouts, becuase I see it alot...ive seen alot of court cases where people get sued for this.
Sure I don't like seeing stuff been ripped thats why I look for media release stuff...
But some times people sell you content or you acquire content thats media release and it may actually not be.

That's not true. I did not say that...
I said they took my layouts.
At this point, it looks like they are direct linking from other sites... I've contacted these site owners to find out if they are product owners and if so, to make them aware of these people direct-linking.
Now, there are ALOT of layouts, so I didn't get to look at all the codes yet to see if they are direct linking from a bunch of sites, or just a couple. I didn't get to see if they are direct linking or not, after about page 5 I got tired of searching and was too pissed to do anymore investigating. I'm sure i'll be back tomorrow to finish.
I do know My layouts are being displayed and distributed without permission. That's what I care bout right now.

We as a Community shouldnt put up with this. I personally have been contacted before cause of content I bought in a pack that was stolen. I have either paid the owner for said content or just removed it.

We don't need to go policing the internet or try to be saints but we definitely should look after and try to protect each other as a community. Even with the thousands of resource sites out there this is still a pretty small world and if the community stood up for each other it would make a difference.
Yeah there are sticky sittuations and gray areas but there are also completely obvious flaws in the ways some people treat others.

Hey, if you wanna find out the kinda people who like their brands being used head over to myspace/bebo etc and look trough all the people who have done deals with them, partenered with them "sponsored profiles etc" and that gives you a general idea. generally, an "everyone" type brand, movies, TV, music ETC LOVE the free promotion through MSRS sites :D

A lot of this wouldn't be happening if designers didn't stop tagging their layouts. As a designer you should demand the layouts you sell be tagged before you deliver them.
Not only that but if people steal the tagged layouts you could then get the site owners like myself who actually have legal counsel on retainer to help you go after them because it would then be obvious that they got it from our sites.
Instead in the interests of a fast buck by mass producing content you can sell over and over again you decided to not tag and now your content is out there in the wild.
If you have a problem tagging because of what you get paid per layout then charge more! If your layouts aren't good enough to charge more then maybe you should consider doing something else and letting the people that can make good layouts do it.... Maybe stop labeling all your sale threads "HQ" while you're at it. (NOT saying that to anyone in particular it's a general trend that seems to be going around).
Not saying "it's your own fault" or anything. Sucks your content got stolen. Just pointing out how you could avoid it in the future.

i dont do layouts. i only send out untagged packs to people I KNOW will tag them.

This sucks. A lot of people work hard creating layouts & graphics and then selling them. Not fair when people rip them off. And then what happens? Nothing? Thats unacceptable.

suggest everyone read up on copyright laws pertaining to derivative works. Here is one url http://www.copyright.gov/circs/circ14.html. It sucks when content is stolen but most of the time the designer is SOL when it comes to these types of situations.

Sorry to break up the sob fest, but **** like this happens. Instead of starting a long thread that's likely to not solve a thing, how about getting back to work to make up for the lost $? In the time it took you to fill 13 pages with drama (I didn't see the offending sites listed, just back and forth.. back and forth), you could have made a lot of layouts, glitters, or whatever.
Tar and feather me now, but it's true, isn't it?
Sorry, but this is the vent it out section and that's what i'm doing - venting.
Thanks to this thread, I have now decided to refuse to sell to certain people - and this thread tells me exactly who to avoid.

We're all entitled to start threads in the "Vent it Out" section about anything that's making us mad [within reason...] . Everyone gave their opinion on what they thought about it, etc.

I actually think I will close this, as I'm trying to just let it blow over right now. I have to much going on for me to have to worry about someone being disrespectful and not removing my layouts.

I do agree though and think most buyers would be willing to pay a little more to include tagging. There are also a few people who offer tagging services now so making deals with them in advanced to have your layouts tagged should be easier. It is a pain but really in everyones best interest in the end.
