If you login to your profile, there is a block of ads, these are google syndicated ads, but they do not have the "Ad By Google" tag. Is Myspace doing this outside of the TOS?

No, you're allowed to change it as long as you denote that it's ads. In fact, you probably will have a higher ctr if you do, but I wonder if myspace changed it to improve ctr or for some other extraneous reason.
How do you like that Wendi? I know you're reading this right now. We know all your little secrets.

Myspace has a special agreement with google and their ads are served separately from the usual google ads system as far as I know.

You used to be able to just change it if you wanted, as long as you still said that they were ads. I guess they changed that in the tos.
